一、案例回放
2002年至2011年7月间，段振豪担任中科院地质与地球物理研究所研究员、计算地球化学及其应用学科组组长，负责科研项目的立项申请、项目执行直至结题验收全过程。而他的秘书车春兰为学科组提供辅助性工作。
二人于2002年至2011年7月间以报销科研经费为由，使用虚假的票据报销差旅费等共计124万余元，段振豪非法占有上述款项后给车春兰少量好处费；2011年5月，段振豪与他人签订虚假的网站开发合同，使用虚假的票据报销网站开发费，骗取科研经费万元；车春兰于2003年至2010年间用假票据报销万。北京市第一中级人民法院以贪污罪判处段振豪有期徒刑13年，判处车春兰有期徒刑10年。

二、涉案手法
段、车二人的涉案手法，主要是找虚假票据以各种名义从科研经费中报销。报销名目包括差旅费、复印装订费、劳务费、租车费以及网站开发费等。为他们提供票据的人包括段振豪的亲友、学生、熟人、同事等。二人假借课题组成员的名义将票据从财务报销，而课题组成员崔某等证实，这些研究内容基本上都是在实验室完成的，崔某本人根本没有因科研出过差。
据段振豪自己的供述，在他虚报的差旅费中，有20多万是保姆张某提供的前往银川的发票，有30多万是蔺某提供的前往大庆的发票，另有20多万是他每年回湖南老家探亲的票据和弟弟提供的发票，另外他还找了一家机票代理公司买了虚假行程单。

！警示一：使用虚假发票套取国家资金，是行为人贪污国家资金的一种手段，如达到一定数额，应定贪污罪。

！！警示二：使用虚假发票达到一定数额，即可构成犯罪。依犯罪主体的不同，可以构成贪污罪、职务侵占罪或者私分国有资产罪。如果使用虚假发票套取的是国家资金，归个人所有的，对国家工作人员可以定贪污罪;对非国家工作人员则可以认定为职务侵占罪;对将套取的国家资金用于发放职工福利的，可以认定为私分国有资产罪。
